Terms of Use

These Terms of Service (“Terms”) govern your use of the ATX Brake Mobile website and online services and the general terms under which you may request or receive mobile brake services from QUERALES ENTERPRISE LLC, doing business as ATX Brake Mobile (“ATX Brake Mobile,” “we,” “us,” or “our”).

Acceptance and Scope

By using our website or online services, or by affirmatively accepting these Terms in connection with a quote, appointment, payment, or service transaction, you agree to these Terms to the extent applicable to your interaction with ATX Brake Mobile.

These Terms apply to atxbrakemobile.com, the online estimator, appointment and contact tools, customer communications, payment links or interfaces, customer-facing electronic documents, and mobile brake services provided by ATX Brake Mobile.

The Scheduling & Cancellation Policy, Service Disclaimer, and Warranty Policy are incorporated into these Terms by reference. Our Privacy Policy is made available with these Terms and governs our personal-information practices.

We may decline to provide access to an online feature or refuse a requested service when reasonably necessary for safety, legal compliance, suspected fraud, lack of authority, unavailable parts or personnel, an unsuitable service location, or another legitimate business reason, subject to applicable law and any payment or refund obligations already incurred.

For purposes of service-related contractual claims, a “Service Customer” is the individual or entity that actually purchased, authorized, or received an ATX Brake Mobile inspection or repair service for the vehicle identified in the applicable transaction. A person who only visits the website, requests information, receives a preliminary estimate, submits an unconfirmed appointment request, or is otherwise unrelated to a performed service does not acquire contractual rights under the Service Agreement / Repair Authorization, Warranty Policy, or service-performance provisions merely through that interaction. This limitation does not eliminate any right or remedy that applicable law gives to a person and does not prevent an authorized vehicle owner or other legally entitled person from asserting a right that cannot lawfully be restricted.

Eligibility, Authority, and Accurate Information

2.1 Eligibility and Authority

You must be at least eighteen (18) years old and legally capable of entering into a binding agreement to authorize a vehicle service.

By requesting or authorizing service, you represent that you are the vehicle owner or are authorized by the owner or another person legally entitled to approve the requested work. If you act for a business, fleet, employer, family member, or other person, you represent that you have authority to act for that person or organization with respect to the transaction.

You also represent that you are authorized to use any payment method you provide. We may request reasonable verification of identity, vehicle authority, property access, or payment authorization when appropriate.

2.2 Accurate Customer and Vehicle Information

You agree to provide information that is accurate and reasonably complete to the best of your knowledge. This may include contact information, service address, vehicle year/make/model, trim or configuration, VIN or license plate when requested, known modifications, warning lights, prior repairs, or other conditions that may materially affect parts selection, service feasibility, safety, or pricing.

You are not expected to diagnose your own vehicle or identify conditions you could not reasonably know. However, you must not knowingly conceal or materially misrepresent information relevant to the requested service.

If material information changes or is discovered to be incorrect, we may revise an estimate, change parts, propose a different appointment, require additional authorization, or decline to proceed when the requested work cannot reasonably be performed as originally planned.

Estimates, Appointment Requests, and Repair Authorization

3.1 Online Estimates and Quotes

Prices or service selections displayed through an online estimator or other preliminary tool are informational estimates based on the information available at the time. They are not a physical inspection, final diagnosis, guarantee of parts fitment, guarantee of service availability, or authorization to perform work.

A quote or estimate may change before final authorization if vehicle information is inaccurate or incomplete, the actual brake configuration differs from what was expected, parts availability or supplier cost changes, a vehicle has aftermarket or damaged components, or an inspection identifies conditions that materially affect the requested work.

If additional work or additional charges become appropriate after service begins, ATX Brake Mobile will request customer authorization before performing chargeable additional repair work, except where applicable law permits otherwise.

3.2 Appointment Requests and Confirmation

Submitting an appointment request, selecting a displayed time, or receiving an automated acknowledgment does not guarantee service or confirm an appointment. An appointment is confirmed only when ATX Brake Mobile communicates that the appointment has been accepted.

Appointment times and arrival windows are scheduling estimates. Mobile service may be affected by traffic, weather, earlier jobs, parts availability, safety conditions, technician availability, or other circumstances. Material scheduling changes will be handled under the Scheduling & Cancellation Policy.

3.3 Authorization to Inspect or Repair

Before ATX Brake Mobile inspects, lifts, disassembles, diagnoses, repairs, moves, or road-tests a vehicle, the customer must provide the authorization required for that activity through the applicable Service Agreement / Repair Authorization or another documented job-specific authorization.

The Service Agreement / Repair Authorization identifies the specific vehicle and the work, parts, labor, pricing, location, and other job-specific terms approved by the customer. Acceptance of these general Terms alone does not authorize vehicle work.

Mobile Service Location and Customer Responsibilities

4.1 Safe and Lawful Service Location

Because ATX Brake Mobile performs work at customer-selected locations, the customer must provide a location that is lawful, accessible, and reasonably suitable for the requested work. The vehicle must be positioned on a firm, stable, substantially level surface with sufficient space for safe access, lifting equipment, tools, and the service vehicle.

ATX Brake Mobile may refuse, pause, relocate, or discontinue service if the location, weather, traffic, property conditions, vehicle position, or surrounding activity creates a material safety or access concern. When reasonably practicable, we may allow the customer to move the vehicle to another acceptable location.

4.2 Property Permission and Access

The customer is responsible for ensuring that mobile automotive service is permitted at the selected location and for obtaining any required permission, parking authorization, gate access, building or property approval, or similar access arrangement within the customer’s control.

ATX Brake Mobile is not required to violate property rules, bypass security procedures, negotiate permission with a property manager on the customer’s behalf, or work in a location that cannot be used safely and lawfully.

4.3 Vehicle and Work-Area Access

The vehicle, keys or access devices when required, and any wheel-lock key or other customer-controlled access item must be reasonably available for the service. The customer should remove or secure unnecessary valuables and keep children, pets, bystanders, and unrelated activity a safe distance from the work area.

The customer must remain reasonably reachable during the appointment when approval, access, revised pricing, or safety information may be needed. ATX Brake Mobile will not move or road-test the vehicle unless that activity is reasonably related to the authorized service and has been authorized as required.

Parts, Service Scope, and Vehicle Conditions

5.1 Scope of Authorized Work

ATX Brake Mobile is responsible for the inspection, repair, parts, and labor specifically authorized for the applicable transaction. Unless expressly included, a brake service does not constitute a complete inspection or diagnosis of every mechanical, electrical, hydraulic, suspension, tire, or other vehicle system.

Observing a condition outside the authorized scope does not automatically expand the work. We may recommend additional service, but chargeable additional work will not be performed without the customer’s authorization.

5.2 Customer-Provided Parts

Unless ATX Brake Mobile expressly agrees otherwise in writing, ATX Brake Mobile does not install customer-provided parts and does not offer labor-only installation using parts supplied by the customer or another third party.

Parts installed by ATX Brake Mobile are selected or approved and supplied by ATX Brake Mobile so that we can evaluate compatibility, source, condition, and warranty eligibility. The Warranty Policy governs any warranty coverage for eligible parts and labor.

5.3 Removed Parts

Removed parts may be recycled, disposed of, returned to a supplier, or retained when reasonably necessary for a core return, warranty claim, legal requirement, or safe handling. If you want an eligible removed part returned, please request it before service begins. Return is subject to applicable law, supplier requirements, safety, and practical handling limitations.

Payments, Fees, Taxes, and Refunds

6.1 Payment

Payment is due according to the applicable quote, Service Agreement / Repair Authorization, payment request, or invoice. Unless another payment schedule is stated, payment is generally due upon completion of the authorized service.

By providing a payment method, you authorize ATX Brake Mobile and its payment providers to process the amounts you approved for the applicable transaction. Electronic payments may be processed by third-party payment providers subject to their own terms and security procedures.

6.2 Deposits and Special-Order Costs

ATX Brake Mobile may require a deposit or advance payment for special-order, high-cost, nonreturnable, or limited-availability parts or for another transaction requiring a material advance expenditure. The amount and material refund conditions will be disclosed before the deposit is collected.

If a customer cancels after ATX Brake Mobile has incurred previously disclosed, reasonable, and documented nonrecoverable costs in reliance on the customer’s authorization, an applicable deposit may be reduced by those costs to the extent permitted by law and the applicable policy.

6.3 Fees and Taxes

Inspection, diagnostic, trip, cancellation, rescheduling, no-show, or similar fees will apply only when the fee and the conditions under which it may be charged were disclosed before the fee was incurred. Scheduling-related fees are governed by the Scheduling & Cancellation Policy.

Customers are responsible for applicable taxes that ATX Brake Mobile is legally required to collect. Taxes will be shown on the applicable transaction documentation.

6.4 Refunds and Payment Disputes

Refund eligibility depends on the work performed, parts ordered or installed, nonrecoverable costs, the reason for the request, the applicable service documents and policies, payment-provider requirements, and applicable law.

If ATX Brake Mobile receives payment for work, parts, or another obligation that is not performed, supplied, incurred, or otherwise lawfully earned, the applicable unearned amount will be refunded as required.

Customers may raise good-faith billing concerns with ATX Brake Mobile and may exercise any lawful right to dispute a charge through a payment provider or financial institution. Knowingly submitting false information to avoid payment for authorized services may constitute a breach of these Terms.

Communications and Electronic Records

When you provide a telephone number, email address, or other contact information, ATX Brake Mobile may use it for communications reasonably related to your inquiry, quote, appointment, service, payment, warranty, safety matter, or customer-support request.

These communications may include confirmations, reminders, scheduling changes, technician or arrival updates, estimates, approvals, payment requests, invoices, receipts, warranty information, and customer-support messages.

7.2 SMS Service Notifications

ATX Brake Mobile uses its SMS program only for transactional service notifications and customer care related to a customer’s quote, appointment, reminders, scheduling updates, technician arrival, service updates, payment, warranty, or support request. This SMS program is not used for marketing or promotional messages.

Message frequency varies based on your appointment and service activity. Message and data rates may apply. Reply STOP to opt out of messages from the applicable sending number. Reply HELP for assistance when available. SMS consent is optional and is not a condition of purchasing or scheduling ATX Brake Mobile services.

7.3 Electronic Signatures and Records

When an electronic process is offered, you agree that electronic records, approvals, acknowledgments, and signatures may be used for transactions with ATX Brake Mobile to the extent permitted by law. An electronic action taken with the intent to accept, approve, authorize, or sign a record may have the same legal effect as a handwritten signature.

Merely visiting a webpage, opening an email, receiving a text message, or viewing a document does not by itself constitute authorization to perform vehicle work. The applicable job-specific authorization must still be provided.

Privacy, Service Photographs, and Records

Our Privacy Policy explains how ATX Brake Mobile collects, uses, discloses, retains, and protects personal information. It also describes our practices regarding website technologies, service records, communications, payments, and privacy rights.

Authorized ATX Brake Mobile personnel may take photographs or create other documentation reasonably related to a vehicle inspection, condition, repair, completed work, warranty matter, or dispute. These records may form part of the applicable service record.

ATX Brake Mobile does not knowingly use identifiable customer information or identifiable service photographs for public advertising or promotional purposes without appropriate authorization. Additional information is provided in the Privacy Policy.

Website, Estimator, and Digital Services

The ATX Brake Mobile website and digital tools are provided for general information, service selection, preliminary pricing, appointment requests, communications, document delivery, and other customer-facing functions.

Website content, estimator results, automated responses, and other preliminary digital information are not a substitute for a physical inspection or final vehicle diagnosis and should not be relied on as a determination that a vehicle is safe to operate.

The website or a digital feature may occasionally be unavailable, delayed, incomplete, or affected by technical errors or third-party service interruptions. We may correct information, update features, suspend functionality, or correct a manifest error when reasonably necessary.

If a clearly erroneous online price or service term results from a typographical, calculation, or technical error, ATX Brake Mobile may correct the error before final job-specific authorization. If payment was collected solely because of such an error and the customer does not accept the corrected transaction, the affected unearned payment will be refunded.

ATX Brake Mobile is not an emergency-response, towing, or roadside-rescue service. If a brake condition presents an immediate safety concern, do not rely on the website or an online response as a substitute for appropriate emergency, towing, or in-person assistance.

9.1 Use of Artificial Intelligence and Automated Tools

ATX Brake Mobile may use artificial intelligence and other automated technologies to support customer communications, preliminary estimates, scheduling and availability information, document preparation or organization, customer support, fraud and security functions, and other administrative or service-support activities.

AI-assisted output may be incomplete or inaccurate and is used as support rather than as a substitute for appropriate human judgment. An AI system is not authorized, by itself, to make a final vehicle-safety determination, issue a final diagnosis, authorize repairs or additional charges on behalf of a customer, deny a warranty claim, or make another decision that applicable law or these Terms require to be made or approved by an authorized person.

When a customer directly interacts with an AI-enabled or automated assistant, ATX Brake Mobile may identify the interaction as automated or AI-assisted when appropriate or required by applicable law. The use of AI does not change the customer’s rights under these Terms, the Privacy Policy, the Service Agreement / Repair Authorization, the Service Disclaimer, or the Warranty Policy.

Intellectual Property

The ATX Brake Mobile name, logo, branding, website content, original photographs, illustrations, graphics, text, software, estimator presentation, and other materials owned or licensed by QUERALES ENTERPRISE LLC are protected by applicable intellectual-property laws.

Subject to these Terms, ATX Brake Mobile grants you a limited, revocable, nonexclusive, nontransferable right to access and use the website and customer-facing materials for lawful personal or internal business purposes related to a genuine ATX Brake Mobile inquiry or transaction.

You may not falsely imply endorsement or affiliation, commercially exploit our protected materials without permission, or copy or use our branding, content, or software in a manner that infringes applicable rights. Nothing in these Terms restricts lawful criticism, reviews, consumer complaints, news reporting, or other uses protected by law.

Prohibited Uses

You may not use the ATX Brake Mobile website, digital services, communications, or customer-facing systems to:

  • violate applicable law or another person’s legal rights;
  • submit fraudulent, abusive, harassing, or intentionally misleading requests or transactions;
  • impersonate another person or falsely claim authority to act for a vehicle owner, payment-method holder, business, or ATX Brake Mobile;
  • gain or attempt to gain unauthorized access to accounts, records, administrative functions, or nonpublic systems;
  • introduce malicious code, interfere with system availability or security, or intentionally overload or disrupt a service;
  • use bots, scraping, automated extraction, or similar methods to collect protected or nonpublic information or to reserve appointments abusively;
  • circumvent access controls, authentication, rate limits, or security safeguards; or
  • use ATX Brake Mobile branding or customer-facing materials in a deceptive manner.

ATX Brake Mobile may restrict access, cancel fraudulent or abusive requests, preserve relevant records, or take other reasonable protective action when we reasonably believe these Terms have been materially violated, subject to applicable law.

Disclaimers

12.1 Website and General Information

To the maximum extent permitted by law, the website and general digital content are provided on an “as is” and “as available” basis for informational and transactional convenience. We do not guarantee uninterrupted availability, error-free operation, or that general website information will address every condition relevant to a particular vehicle.

12.2 Vehicle-Specific Service

The scope and limitations of vehicle inspections, estimates, recommendations, authorized repairs, and vehicle-condition findings are further described in the Service Disclaimer and the applicable Service Agreement / Repair Authorization.

ATX Brake Mobile does not undertake to inspect or repair systems outside the authorized scope merely because another condition is visible or discovered. Nothing in these Terms limits our responsibility to perform accepted work with the level of care required by law or to honor an applicable express warranty.

12.3 Third-Party Services

Our website or communications may link to or use independently operated payment, mapping, communications, social-media, or other third-party services. ATX Brake Mobile does not control their independent content, systems, policies, or service availability. Your direct use of a third-party service may also be subject to that provider’s terms and privacy notice.

12.4 Nonwaivable Rights

Nothing in these Terms, the Service Disclaimer, or another ATX Brake Mobile policy excludes or limits fraud, intentional misconduct, gross negligence, an express written warranty, or a consumer right or remedy that applicable law does not permit the parties to exclude or limit.

Limitation of Liability

To the maximum extent permitted by applicable law, ATX Brake Mobile will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from the website, online estimator, preliminary digital information, electronic communications, or an independently operated third-party technology service.

This limitation may include, when legally classified as indirect or consequential damages, loss of data, business opportunity, profits, revenue, goodwill, or costs arising from inability to access an online feature.

These limitations do not apply to the extent a claim involves fraud, intentional misconduct, gross negligence, death or bodily injury, physical damage to tangible property caused by ATX Brake Mobile where liability cannot lawfully be limited, an applicable express warranty, an unauthorized charge, a required refund, or another statutory or legal remedy that cannot lawfully be limited.

No provision of these Terms limits ATX Brake Mobile’s responsibility for the authorized inspection or repair work it actually accepts to the extent applicable law requires that responsibility.

Limited Indemnification

To the maximum extent permitted by law, you agree to indemnify and hold harmless QUERALES ENTERPRISE LLC, doing business as ATX Brake Mobile, from reasonable and documented third-party claims, losses, or defense costs to the extent directly caused by your knowing or fraudulent:

  • misuse of the website, payment systems, communications, or service documents;
  • authorization of vehicle work without lawful authority from the vehicle owner or another authorized person;
  • use of a payment method without authorization;
  • material misrepresentation concerning identity, authority, vehicle information, or property permission;
  • infringement of another person’s intellectual-property or privacy rights through materials you provide; or
  • unauthorized access to or intentional interference with ATX Brake Mobile systems.

This indemnification obligation does not apply to the extent a claim or loss is caused by ATX Brake Mobile’s own negligence, fraud, intentional misconduct, gross negligence, breach of an express warranty, unlawful conduct, unauthorized work, or another responsibility that applicable law assigns to ATX Brake Mobile.

Dispute Resolution and Arbitration

The customer dispute procedures in this Section may be invoked for a claim concerning the performance, quality, scope, parts, labor, warranty, or outcome of an ATX Brake Mobile vehicle service only by the applicable Service Customer, or by another person who has a legally enforceable right concerning that specific transaction under applicable law.

A website visitor, prospective customer, or other person who did not purchase, authorize, or receive the applicable vehicle service may not assert contractual rights based on the performance, quality, warranty, scope, or outcome of that service merely because the person accessed the website, communicated with ATX Brake Mobile, or viewed an estimate. Nothing in this subsection restricts a statutory, property, tort, privacy, or other right that applicable law gives to a person independently of the service contract.

15.2 Informal Resolution

Before initiating arbitration, the complaining party must provide the other party with a written Notice of Dispute describing the issue and the relief requested and allow thirty (30) calendar days for a good-faith effort to resolve the matter informally.

A customer may send a Notice of Dispute to [email protected] with the subject line “Notice of Dispute.” The notice should include enough information to identify the relevant transaction and explain the dispute without including unnecessary sensitive information.

15.3 Small Claims Court

Either party may bring an eligible individual claim in a court of competent small claims jurisdiction only in Travis County, Texas, to the maximum extent a contractual forum-selection requirement is permitted and enforceable under applicable law. A small claims case must remain an individual proceeding and within that court’s jurisdiction.

15.4 Binding Individual Arbitration

Except as otherwise stated in this section, any dispute, claim, or controversy arising out of or relating to these Terms, an incorporated policy, the website or online services, an appointment, estimate, authorization, inspection, repair, parts, labor, payment, refund, warranty, customer communication, or the relationship between the customer and ATX Brake Mobile will be resolved through final and binding individual arbitration.

Arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules in effect when the matter is filed, as modified by this agreement and subject to applicable consumer due-process requirements. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.

The customer will be responsible only for the consumer filing fee required by the applicable rules, subject to any available waiver or reduction. ATX Brake Mobile will pay fees allocated to the business under the applicable consumer arbitration rules. Each party will ordinarily bear its own attorneys’ fees and costs unless the arbitrator or applicable law provides otherwise.

An arbitration hearing may occur through written submissions, telephone, video conference, or in person as allowed by the applicable rules. An in-person hearing, if required, will occur at a reasonably convenient location in or near the county where the applicable ATX Brake Mobile service occurred, unless the parties agree otherwise or the arbitrator determines another location is appropriate.

The arbitrator may award individual relief that a court could lawfully award and will issue a written decision as required by the applicable rules. A court of competent jurisdiction may enter judgment on the arbitration award.

15.5 Class Action and Jury Trial Waiver

To the maximum extent permitted by law, arbitration will proceed only on an individual basis. Neither party may bring or participate in a class, collective, consolidated, or representative arbitration or seek relief on behalf of persons who are not parties to the individual proceeding.

For disputes required to be arbitrated, you and ATX Brake Mobile waive the right to have the dispute decided by a judge or jury in court.

15.6 Right to Opt Out of Arbitration

You may opt out of this arbitration agreement and class action waiver by sending written notice within thirty (30) calendar days after you first accept these Terms.

The notice must identify you by name, provide the email address or telephone number associated with the applicable transaction, and clearly state that you are opting out of Section 15 of the ATX Brake Mobile Terms of Service.

A valid opt-out affects only the person who submitted it and does not affect that person’s ability to request or receive ATX Brake Mobile services.

15.7 Matters Not Restricted by Arbitration

Nothing in this section prevents either party from bringing an eligible individual small claims case, reporting a matter to a governmental or regulatory authority, cooperating with an investigation, seeking temporary court relief to prevent immediate misuse of intellectual property or unauthorized system access, or pursuing a claim that applicable law does not permit to be subjected to predispute arbitration.

15.8 Severability

If part of this arbitration agreement is found unenforceable, it will be limited or severed to the minimum extent necessary and the remainder will continue to apply, except where applicable law requires a different result.
